These Terms of Service ("Terms") govern your access to and use of the Arboreal Labs website, platforms, and services (collectively, the "Services"). By using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Our Services

Arboreal Labs designs, builds, and operates custom software, AI tools, websites, and ready-to-use platforms including GrowX CRM, Athena LMS, and FlowForge OS. Specific commercial terms (scope, pricing, and timelines) for custom projects or platform subscriptions are set out in a separate agreement or order.

2. Software & Intellectual Property

Our platforms are provided as a fully managed, hosted service. Unless your written agreement states otherwise, Arboreal Labs retains all intellectual property rights in its software, source code, designs, and underlying technology. We do not transfer or hand over source code. You are granted a non-exclusive, non-transferable right to use the Services for your business during the term of your agreement.

3. Your Data

You retain ownership of the business data you and your users enter into our platforms. We process it solely to provide the Services, and you may export your data at any time. Our handling of personal information is described in our Privacy Policy.

4. Acceptable Use

Do not use the Services for any unlawful, harmful, or fraudulent purpose.
Do not attempt to copy, decompile, reverse-engineer, or gain unauthorised access to our software or infrastructure.
Do not interfere with or disrupt the integrity or performance of the Services.
You are responsible for keeping your account credentials secure and for activity under your account.

5. Fees & Payment

Where the Services are provided on a paid basis, fees, billing cycles, and payment terms are as stated in your order or subscription. Unless required by law, fees are non-refundable once the relevant period has begun.

6. Service Availability

We work to keep the Services available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or improvements that temporarily affect availability, and we may modify features over time.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Arboreal Labs shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits or data, arising from your use of the Services. Our total liability for any claim is limited to the amount you paid us for the Services in the twelve months preceding the claim.

9. Termination

Either party may terminate the Services in accordance with the applicable agreement. Upon termination, your right to use the Services ends, and we will make your exported data available to you for a reasonable period before deletion.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
